(“Out of Peru”) (Company no. 6973210).  All contents displayed on the website including design, text, graphics and images belong to Out of Peru; similarly with all copyright, trade marks and other intellectual property, unless otherwise indicated.  All photos used on the website are copyright of Out of Peru, unless otherwise indicated.  Out of Peru allow the downloading, printing or copying from this site for personal use only and the sole intent of purchasing the products from Out of Peru.  Any other usage of this website material without the written consent of Out of Peru is not allowed otherwise under any circumstances.

3) Out of Peru reserve the right, if seen as necessary, to revise and alter all information on this site without prior notification to the consumer.  The consumer is responsible for checking regularly online to ascertain any changes made.  On reviewing the alterations made to the website, if the consumer chooses to continue using this website this implies the acceptance and willingness to comply with the new agreement.

8) Out of Peru will not be liable for any loss of profit, loss of either direct or indirect anticipated revenue or any consequential or indirect loss.

Product Quality

1) Out of Peru takes great care and time to ensure every item of jewellery is portrayed correctly and described accurately.  However, Out of Peru’s items are handcrafted, therefore each piece will vary individually, particularly in the case of the natural stones.  Out of Peru cannot guarantee that the item sold will be identical to previous items.  Out of Peru uses its best efforts to make certain the items supplied match the product descriptions given on the website.

2) Customers using the website to purchase items from Out of Peru should be aware that the colour disparities that can occur between individual computer screens may cause a discrepancy between the colour shown on the website and the actual product.  If the customer is unhappy with any item they have purchased, we are happy for them to return the item unused and in the packaging supplied.  Please see our Return Policy for more information.

3) All items made of silver that are supplied by Out of Peru are produced using either 925 or 950 Sterling silver (as seen stamped on the jewellery item).  The jewellery complies with UK Assay legislation and is stamped by The London Assay Office:

4) If item (3) does not apply, Out of Peru does not guarantee there is a complete absence of nickel or other components in its products.  Out of Peru will not accept any liability for any known or unknown allergic reactions that occur as a result of our products.

Sales of Products

2) Out of Peru try to ensure all information placed on the website in regards to pricing is accurate.  In the event of incorrect pricing, the consumer will be informed by email of the correct price and a choice of continuing with the purchase or cancelling the order fully.  If the consumer is satisfied with the updated price and would like to still purchase the product, this transaction will be carried forward by Out of Peru.  However, if the product is no longer desired and a charge has already occurred then the consumer’s money will be refunded.  If the product has already been dispatched, the refund will be issued on return of the product.

Payment

1) Items are to be purchased using a money order or cheque.  Items will not be dispatched until the payments have been cleared.  For cheques this can take up to 5 working days.  Once the payment has been cleared, the item will be dispatched.

2) All purchases will be charged in GB Pound Sterling. The conversion to currencies other than GBP is for information purposes only.

2) In the case of a product not being immediately available, a charge will not be made to the consumer until the product is ready to be dispatched.  If the order cannot be completed in 30 days, Out of Peru shall contact the customer with the option of either determining another delivery date or cancelling the order. 

Delivery

1) All items will be dispatched once payments have cleared, subject to the item being in stock.  Please allow 2 – 3 days for delivery within the UK from the date the item is dispatched.  If the item is being sent overseas, delivery can take up to 6 working days.

2) Orders over £500.00 are Free Delivery Orders to UK addresses.  Orders under £500.00 have a £5.95 shipping and handling charge within the UK.  Items being shipped overseas will be charged £10.95 for shipping and handling.

Returns Policy

1) Out of Peru want to ensure our customers have 100% satisfaction with their purchases from www.outofperu.co.uk.  We appreciate that buying items over the Internet is not the same as being able to sample the item in a shop.  If, for whatever reasons, you feel the item is not suited to you, then provided you return the item in its original packaging within 14 days a full refund will be issued to you within 30 days.  Unfortunately any packaging and posting costs will be unable to be refunded.  Please see our Return Policy page for more information.

Defective Goods

1) Out of Peru Silver’s jewellery is handmade from 925 or 950 sterling silver and semi-precious stones sourced from Peru. All items are quality checked prior to being offered for sale.  We do, however, recognize that faults can occur in handmade items so are happy to offer a full refund, repair or replace any item for 6 months after delivery.

2) If an item is no longer stocked or the item is unable to be repaired then Out of Peru may choose to refund the full price paid.

3) For any replacement items sent out, postage and packing will be free of charge.

Law and Jurisdiction

1) These Terms and Conditions, all disclaimers and any other material contained on this website will be governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.

2) Out of Peru has the right to change the Terms and Conditions as seen fit.  Once changes have been posted on the site, they become effective immediately.  By continuing using the Out of Peru website indicated the customer accepts any changes or variations applied.

3) In the case of Out of Peru not exercising or enforcing any right or provision of the Terms and Conditions  this does not constitute a waiver of such right or provision.
